One Dead After Pedestrian Struck on I-10 in Los Angeles, CA

Los Angeles, CA (August 4, 2026) – A pedestrian was killed early Monday morning, August 3, after being struck on the westbound 10 Freeway near the 110 Freeway interchange.

The crash was reported at approximately 3:45 a.m. west of Vermont Avenue. The California Highway Patrol responded to the scene, and the pedestrian was pronounced dead at the location.

All westbound lanes were initially closed, with an hours-long SigAlert backing up traffic for miles during the morning commute. No further details about the pedestrian’s identity have been released.

The California Highway Patrol continues to look into the circumstances surrounding the crash.

We extend our sincere condolences to the pedestrian’s family and loved ones.

How California’s Wrongful Death and Survival Action Laws Apply to Pedestrian Fatalities

When someone dies after being struck, California law offers surviving family members two distinct legal paths that work together.

A wrongful death claim allows a spouse, children, or other qualifying heirs to seek compensation for their own losses, including lost financial support and loss of companionship, while a separate survival action allows the estate to recover for what the deceased person experienced before passing, such as pain or medical costs incurred in the moments before death.

California follows a pure comparative negligence rule, which means a family can still recover compensation even if the pedestrian is found partially at fault, though any award would be reduced by that percentage.

Given how much these cases can turn on unresolved details, a personal injury lawyer can play an important role in requesting CHP incident reports, dashcam footage from passing vehicles, and toxicology or maintenance records.

Losing someone in a crash raises difficult questions, and California’s approach to wrongful death and survival actions can be hard to sort out while a family is grieving. At Saleh Law Group, our team can help explain how these two types of claims differ and how the ongoing investigation might affect either one.
