Filing Deadlines Matter More When a Driver Flees the Scene in Boyle Heights, CA
When a driver leaves the scene, families can face a harder path toward compensation simply because the responsible party hasn’t been identified yet. California generally gives families two years from the date of death to file a wrongful death claim, but that clock doesn’t pause while police work to locate a driver, which puts pressure on early investigation.
If the driver is never identified, families can typically turn to the deceased’s own uninsured motorist coverage, assuming a policy was in place, to recover certain losses instead of pursuing the driver directly. California requires insurers to offer this coverage, and it commonly applies in situations exactly like this one, where the at-fault party fled and remains unknown.
Because so much depends on whether police can identify the driver, evidence gathered quickly, traffic camera footage, paint transfer, or witness accounts can shape whether a family pursues a claim against the driver, an uninsured motorist claim, or both.
A car accident lawyer can help a family track the investigation’s progress and make sure any applicable deadlines aren’t missed while that process plays out.
