Passenger Rights After a Car Accident in Winnetka, CA
Passengers injured in a vehicle collision generally have more straightforward legal standing than drivers, since they typically bear no responsibility for how a crash occurred.
Because passengers usually aren’t at fault, they can usually pursue a claim against the driver of the vehicle they were riding in, another driver involved, or in some cases, a government entity if a road hazard contributed to the crash. Injuries commonly seen in passengers range from whiplash and fractures to more serious trauma like internal injuries or head trauma, depending on where they were seated and how the vehicle was impacted.
California follows a pure comparative negligence system, which benefits passengers significantly since their compensation isn’t reduced due to any fault on their part, even if the driver they were riding with is found partially or fully responsible.
This system can make a passenger’s claim more straightforward than a driver’s, though it still requires clear documentation of the crash and resulting injuries. A car accident lawyer can help a passenger identify every insurance policy that may apply, including the driver’s coverage and any other vehicle involved, since passengers aren’t limited to filing against just one party.
