Can a Family File a Wrongful Death Claim After a Freeway Crash in Montebello, CA?
Yes, in California, a family can file a wrongful death claim after a fatal freeway crash. The surviving spouse, children, or domestic partner of the person who died can bring the lawsuit. If none of those apply, anyone who would inherit under California law may be eligible to file.
California gives families two years from the date of death to file a wrongful death lawsuit. That deadline is strict, and missing it can permanently block the case. Starting the process early helps preserve key evidence like freeway camera footage and witness statements.
After losing a loved one, the types of compensation a family may seek include funeral costs, lost income, and loss of companionship. California law also allows families to pursue damages for the emotional pain caused by the death. Each case is different, and the amount depends on the specific facts.
Because California follows a pure comparative negligence rule, a family can still recover compensation even if the person who died shared some fault. The total amount may be reduced based on the percentage of blame assigned to them.
