How Long Do Families Have to File a Wrongful Death Claim in Los Angeles?

In Los Angeles and throughout California, families have two years from the date of death to file a wrongful death claim. This deadline is known as the statute of limitations and applies in most cases. Missing this deadline can prevent families from pursuing compensation through the court system.

The two-year clock starts on the date the victim dies. In most cases, that date is straightforward. When a death follows an extended period of medical treatment, the timeline may begin differently, and confirming the exact start date matters.

Some circumstances can pause or extend the filing deadline. If a potential defendant is a government entity, the timeline may shorten significantly, and a government claim may need to be filed within six months. Minors and people with certain legal disabilities have different deadlines under California law.

California law limits who can bring a wrongful death claim. Eligible parties generally include surviving spouses, domestic partners, children, and, in some cases, other dependents. A person who does not qualify under California’s wrongful death statute cannot file independently, regardless of their relationship to the victim.

Missing the filing deadline almost always ends a family’s ability to recover compensation through the courts. Once the statute of limitations expires, courts typically dismiss the case without reviewing its merits. Filing on time is one of the most important steps a family can take to preserve their legal options.

Families benefit from taking early action even before deciding whether to file. Gathering documentation, preserving evidence, and identifying witnesses becomes harder as time passes. Early steps help protect a claim and give an attorney the information needed to evaluate the case.

A personal injury lawyer tracks filing deadlines, confirms when the clock started, and identifies any exceptions that apply. They handle legal filings, gather evidence, and communicate with insurers. Legal guidance helps prevent missed deadlines and ensure the claim is properly submitted.
